Do My Spouse’s Hours Count Toward Material Participation?
Generally, a spouse’s participation is taken into account in determining whether you materially participate — which surprises people in both directions. Here is what that does and does not mean for your records.
The general rule
The regulations provide that participation by your spouse counts as your participation, and this holds whether or not you file jointly and whether or not the spouse has an ownership interest. For couples where one partner handles guest communication and the other handles maintenance, that is a meaningful combined total.
It is also why some households clear a threshold they would each miss individually — the combined hours are what get measured against the test.
Why you should still log them separately
Combining at the point of the test is not the same as combining in your records. Track each person’s entries under their own name, because:
- The tests can be applied in more than one way, and separate figures let your CPA choose; merged figures cannot be unmerged.
- A log that never distinguishes who did what is less credible, not more.
- If circumstances change — separation, a spouse stopping involvement — you need the history intact.
- For the 100-hour test, the comparison against other individuals is easier to explain when your own side is itemised clearly.
What it does not do
Counting your spouse’s hours does not lower the threshold, and it does not change the seven-day average-stay condition, which is a property fact independent of who worked on it. It also does not make a third party’s hours disappear — a property manager working 200 hours is still 200 hours on the other side of the comparison.
